I appreciate there has been a lot of negative stuff going around the mtb forums with regard to the 2008 range of MARZOCCHI forks. I too have had issues; but what I will say is that Windwave (the UK importer/distributor) have come through and done an excellent job of sorting mine out.
So what I would say is give them a call and explain the problem; I am sure they will do their best to help and get you back on your bike super fast.
